Even if you do not believe in "going after" someone who may appear to have innocently caused you harm, it is often better to receive money from them or their insurance and give it to charity than to do nothing at all.

If you have been in an accident, or someone has caused you harm, it is important to:

Preserve the evidence. Take photographs. Note witness names and telephone numbers.
Speak to no one about what happened to you, except your spouse or your attorney. In particular, do not speak to insurance adjusters who call and ask you to give a statement over the phone.
Sign nothing. A few hundred dollars paid you in exchange for a signed release may be the end of your case.
Contact counsel as soon as possible. Evidence disappears quickly, and the sooner you begin assembling your case the better recovery you will have.

Our clients begin by completing our personal injury questionnaire. It covers all aspects of what happened to you, how it happened, and how you were harmed. The document is sent to you without any cost or obligation whatsoever.
After you return the questionnaire, we contact you by telephone. If we are able to represent you we also send a contract for legal services, setting forth that we will represent you for a percentage of any settlement or judgment (or on an hourly basis), plus expenses.
You return the contract with your check for those expenses that we can estimate at the outset.
We send you release forms allowing us to receive documents and reports from your health care providers.
When you have finished treating (doctors call this your "maximum improvement level"), we send a demand letter. This letter sets forth what happened to you, attaching bills and reports, and requesting a dollar amount in settlement of your claim.
If we cannot reach agreement with the other party, we file suit.
